Privacy Policy

Introduction

In accordance with the General Data Protection Regulation (GDPR), Kungsäter-Industri (“we”) has developed the following privacy policy. The GDPR is applicable law within the EU member states and aims to strengthen the protection of individuals’ personal data.

The General Data Protection Regulation contains provisions regarding the processing of personal data. It also sets out rules regarding your rights to information and access to personal data. It further outlines your options for requesting corrections and, in certain cases, restricting the processing of personal data.

It is our policy to take all necessary measures to ensure that the processing of personal data in our operations complies with the provisions of the law. In addition, we aim to process personal data in a fair and transparent manner.

What is personal data?

Personal data is any information that can be directly or indirectly linked to a living individual, such as a name, address, email address, and phone number.

When is personal data processed?

We process personal data in connection with:

  • Quotes and price inquiries
  • Completed sale
  • Previous customer interactions
  • Trade Shows and Events
  • Supplier relationships
  • Expressions of interest in our products or services
  • Contact us via email, phone, or our website
  • Recruitment and Job Applications

We will collect certain personal data in connection with, for example, credit checks and the onboarding of new customers or prospects.

Data processing is conducted in accordance with applicable laws, which means that personal data shall not be retained for longer than is necessary for the purposes for which it was collected. We will process your personal data for as long as you have a relationship with us—in other words, for as long as we perform deliveries, provide service, carry out installations, receive payments, and also during the warranty period or due to specific legal requirements. The data will be deleted when it is no longer necessary or relevant for the purposes for which it was collected. Certain information may be retained for a longer period if required by law, such as the Accounting Act.

Legal basis, storage, and deletion of personal data

In order to process personal data lawfully, there must be a legal basis for such processing. As a legal basis for processing, we will refer to the performance of a contract and also to a so-called balancing of interests regarding a legitimate interest. If we rely on legitimate interest as the basis, this will be done in the situations described above. We have also concluded, through a balancing of interests, that the personal data being processed is based on a legitimate interest; therefore, no explicit consent from you is required.

We store your personal data for as long as is deemed necessary to fulfill the purpose for which the data was collected.

Transfer of personal data

We may need to share your personal data with other parties. If we share this information with a third party, that party is responsible for ensuring that the information is processed correctly and securely. We may also need to disclose your personal data to third parties in order to comply with legal requirements under applicable laws and regulations.

We may share your personal information:

  • When purchasing or selling the goods and services offered by the company, certain personal data will need to be shared, as it serves to identify the buyer and seller. This may occur, for example, in situations involving shipping, warranties, installation, registration, and similar matters.
  • With parties that provide server services, Office 365, and similar services. Data processing agreements will be entered into with such parties where appropriate.
  • In cases where we are required by law to disclose certain information to government agencies. For example, by disclosing information to the Swedish Tax Agency.

Your rights and choices

  • Right to access your data

You can request a copy—known as a data subject report—of your personal data and verify the information we have about you. You may do so once per calendar year.

  • Right to have personal data corrected

You have the right to correct any inaccurate or incomplete information about yourself.

  • Right to erasure (“right to be forgotten”)

You have the right to request the erasure of your personal data if the information is no longer necessary for the purpose for which it was collected. However, there may be other legal obligations that prevent us from immediately complying with such a request. These obligations may arise from, for example, accounting and tax laws. In such cases, we restrict the data we are required to retain so that it cannot be used for any purpose other than fulfilling such legal obligations.

We will, on our own initiative or at the customer’s request, correct any information found to be inaccurate. You may also request that your data be deleted or that its use be restricted by contacting us. If you believe that your rights and personal data are not being handled properly, please feel free to contact us or contact the Swedish Data Protection Authority (IMY).

Requests must be made in writing, signed by the applicant, and include the applicant’s first and last name, phone number, customer number (if applicable), and Social Security number, as well as any specific information you require. This is to ensure that the person requesting the information is the individual to whom the information pertains.

The request should be sent by certified mail to:
